Terms and conditions

This is a translation of the Dutch text. If the English and the Dutch versions differ, the Dutch version applies.

These are the agreements between you and Smaquli. We have written them in plain language. If something is unclear, email us.

1. Who we are

By "Smaquli", "we" and "us" we mean the business behind the app and the website. By "you" we mean you, when you use the app or the website.

We do not have a phone number. Email us, or use the form on the Contact page.

These terms apply to the app and to the website smaquli.com. How we handle your data is explained in the privacy statement and the cookie statement.

2. The service

Smaquli is a recipe book as an app. You save recipes from a recipe website (paste a link), from a video on TikTok, Instagram or YouTube, or from text you paste. You can also dictate or type a recipe yourself. Smaquli turns what you save into a proper recipe with separate ingredients and steps. That lets you change the number of servings, make a shopping list, swap an ingredient and find your recipes again.

It is a web app: you install it from your browser on Android or iPhone. There is no app in the App Store or on Google Play. The app is in Dutch for now. Videos can be 10 minutes long at most and a recording 5 minutes at most.

You can find the app at app.smaquli.com. Until it is open, you can join the waiting list. The privacy statement applies to that.

3. Account and household

To use Smaquli you create an account with your name, your email address and a password. You must be at least 16 years old to create an account. Give correct details and keep your password to yourself. If you think someone else can get into your account, email us as soon as possible.

The app does not send email. So you cannot reset a forgotten password by email: that goes through the owner of your household.

Smaquli works per household. The people in a household share one recipe book and one shopping list, and everyone gives their own ratings. You invite someone with a link. The link is valid for 7 days and works once. Everyone in the household follows these terms.

The subscription belongs to the owner of the household. Only the owner manages the subscription. The owner also takes it out and pays for it.

4. Free and Premium

Smaquli has two plans: Free (called "Gratis" in the app) and Premium. There is also an overview on the Pricing page.

Free costs nothing and includes:

• 1 person in the household
• at most 10 saved recipes, including ones you type yourself
• 2 imports a month (a link, video, text or recording)
• 2 swaps of an ingredient or checks of the method a month in total
• unlimited changing of the number of servings, using the shopping list and searching

Premium costs €4.99 a month or €39.99 a year and includes:

• 4 people in the household, up to 10 with extra people (article 8)
• unlimited saved recipes
• unlimited importing
• unlimited swapping of ingredients and checks of the method
• unlimited typing of your own recipes, changing the number of servings, using the shopping list and searching
• cooking together with the others in your household, which is only possible with Premium

"Unlimited" in Premium comes with a safeguard against misuse (article 9).

5. Prices and payment

All prices include 21% VAT.

• Premium: €4.99 a month or €39.99 a year. With a yearly subscription you pay €39.99 instead of €59.88 (12 × €4.99).
• Extra person: €1 a month, or €12 a year with a yearly subscription (article 8).

You pay through Mollie. You make the first payment with iDEAL, credit card or Bancontact. By doing so you give us permission to collect the amount automatically at each renewal after that. We do not keep card or bank details, only the status of your payments and your subscription.

Premium runs per month or per year and renews itself at the end of each period, until you cancel. If a payment does not go through, the payment service tries again a few times. Premium keeps working in the meantime, up to 10 days after the end of the paid period. If the payment still fails, the subscription stops. From then on the limits of Free apply (article 4), and for your recipes what article 6 says.

6. Cancelling

You can cancel Premium at any time. The owner of the household does that, in the app. Cancelling costs nothing.

Premium runs until the end of the period you have paid for. After that Premium stops and we take no further payments. From then on the limits of Free apply (article 4), with one exception for your recipes:

• 20 recipes stay active. You choose which ones.
• The rest goes into the vault. They are kept there: you see the title and the photo, but the contents are locked.
• Take Premium again and everything is back straight away. We delete nothing.

For the period that is already running you do not get any money back, unless you withdraw (article 7) or the law says otherwise.

7. Withdrawing from the contract

You can withdraw within 14 days of your first payment, without giving a reason. You then get your payments back, including those for extra people, and Premium stops straight away.

• The app has a button for this: "Herroep hier de overeenkomst" (in English: "Withdraw from the contract here"). The owner of the household uses it.
• You can also send an email to info@smaquli.com saying that you withdraw.

We refund you in the same way you paid, within 14 days of you withdrawing.

8. Extra people

Premium includes 4 people in your household. With extra people you can have up to 10. An extra person costs €1 a month, or €12 a year with a yearly subscription. Only the owner of the household arranges this.

• Adding someone with a yearly subscription: you pay straight away, pro rata, for each whole month left in your year. If there are 7 left, you pay €7.
• Adding someone with a monthly subscription: you usually pay only from the next payment.
• Fewer extra people: it becomes cheaper from the next payment. You get nothing back for the period that is already running.

9. Reasonable use

"Unlimited" in Premium means unlimited for normal use. To prevent misuse there is a safeguard: at most 30 imports and 60 AI actions per person per hour. An AI action is, for example, swapping an ingredient or having the method checked. If you reach a limit, try again later.

Do not use Smaquli to get around the safeguard, to overload or disrupt the app, to break into someone else's account or to do anything that is against the law. If you do, we may restrict or end your access. We will tell you, unless that is not reasonable.

10. Your recipes and what Smaquli may do with them

What you add yourself, such as your own recipes, photos, notes and ratings, stays yours. A recipe you save from somewhere else stays with whoever made it. Only save what you are allowed to save.

To make Smaquli work for you, we may store your recipes and what goes with them, show them to the people in your household, convert them, translate them, have them processed by AI (article 11) and include them in backups. We do not use them for anything else. If you have your account deleted, we delete your recipes too. They may stay in backups for a while (see the privacy statement).

You can always export your recipes and lists. The export is a JSON file; photos are included as references. A recipe you delete stays in the bin for 30 days.

If you have a free account and don't log in for 12 months, you get an email. If you still don't log in during the month after that, we delete your account and everything in it. If you want to keep your recipes, log in or export them.

11. AI and checking for yourself

Smaquli uses AI to read and translate recipes, convert amounts to grams, ml and °C, transcribe speech, suggest a different ingredient and check a method. Smaquli also makes its own estimate of the difficulty, the amount of chopping, the type (vegetarian, fish or meat) and the way of cooking (oven, air fryer, one pan). Your own choice always wins.

AI can make mistakes. An amount, unit, time or temperature can be wrong, and an ingredient can be misread or swapped wrongly. So check the amounts, the temperatures and the allergens yourself before you cook. If you cook for someone with an allergy or a special diet, read the packaging of what you buy as well. If a recipe says vegetarian, fish or meat, that is an estimate.

That is why you always see a new recipe on a review screen first, before you save it. When Smaquli assumes or changes something, for example after you dictate a recipe or swap an ingredient, it is marked. With many more or many fewer servings, the pan and the cooking time are often no longer right. Smaquli then gives a hint, and you can have the method checked by AI. That is a tool, not a guarantee.

Smaquli does not calculate nutritional values and does not give nutrition or health advice.

12. Availability

We do our best to keep Smaquli available, but we cannot promise that it always works. Maintenance and outages happen. Your shopping list also works without a connection and syncs afterwards.

Importing partly depends on the source. Some recipe websites block fetching, and Facebook and Pinterest do not work with a link: paste the text of the recipe instead. So an import can fail even if your link is correct.

We make an encrypted backup every day. If you want to be extra sure of your recipes, export them yourself (article 10).

13. Liability

These terms do not take away any of the rights the law gives you as a consumer.

We are liable for damage you suffer because we fail to do what we should, as far as the law provides. Our liability is limited to the amount you paid us in the twelve months before the damage. That limit does not apply in the case of intent or gross negligence, and not where the law does not allow such a limit.

If you follow a recipe without checking the amounts, temperatures and allergens (article 11), that can count when deciding who bears the damage. We are not responsible for the websites and apps your recipes come from.

14. Changes

We can change Smaquli: add, adjust or remove features, and change the limits of Free and Premium. We can change these terms and our prices. The latest version of the terms is always on this page.

We announce a change that is less favourable to you at least 30 days in advance, by email to the address of your account. A higher price only applies from your next renewal. If you do not agree with a change, you can cancel (article 6) before it takes effect.

15. Applicable law and complaints

Dutch law applies to these terms. If you live in another country, you keep the protection of the mandatory consumer rules of your country.

If you have a complaint, email it to info@smaquli.com. Tell us what happened and we will look into it and reply as soon as we can. If we cannot work it out together, you can take it to the court that has jurisdiction under the law.

These terms exist in Dutch and in English. If the two differ, the Dutch text applies. If a provision is not valid, the other provisions still apply.
